(AP Photo/Andrew Welsh-Huggins)

(AP) ? A condemned obese killer should be spared because of lingering doubts about his "legal and moral guilt" and the conduct of defense and prosecution lawyers at trial, his attorneys told the state Parole Board on Thursday in a bid for clemency focusing on his innocence, not his weight.

Death row inmate Ronald Post is fighting his January execution on the grounds that he is so fat he can't be humanely executed and will suffer cruel and unusual punishment as the state struggles to find his veins or give him enough drugs to put someone his size to death.

That argument is in the federal courts, while the 450-pound Post pursues an innocence claim unrelated to his weight before the parole board. The panel considers requests for mercy before making a recommendation to Gov. John Kasich, who has the final say.

Attorneys for Post made presentations to the parole board Thursday followed by prosecutors from Lorain County and the attorney general's office.

Post, 53, was sentenced to die for the 1983 shooting of Elyria motel clerk Helen Vantz during a robbery. Vantz' sons, William and Michael, both attended Thursday's hearing.

At a break, both said they believe firmly in Post's guilt. William Vantz also had harsh words for Post's obesity claim.

"It's just another way for a coward to try and get out of what debt he owes to society," Vantz said.

The long-held presumption that Post confessed to the murder to several people has been falsely exaggerated, Post's attorneys argue. Post admitted involvement in the crime as the get-away driver to a police informant but did not admit to the killing.

"Sure ain't no murderer," Post told that informant, according to Post's clemency filing.

Doubt about Post's guilt lingers because of the involvement of two other men in the shooting, Post's attorneys argue. Post pleaded no contest to the crime on the advice of his attorney in expectation he would receive a life sentence, the attorneys argue. Even after his plea, he told a psychologist "he was not a murderer."

The attorneys also argue that prosecutors misrepresented to the judge that Post had confessed to sole involvement in Vantz's death.

They also say a police detective served as a "double agent" on the case, performing a lie detector test on Post for the defense team while working for the state to perform a similar test on an alleged conspirator in the motel shooting. The detective, "an agent of Post's defense team, violated a basic duty of loyalty and confidentiality to Post," the inmate's attorneys said.

"Lingering doubts exist about the degree of Ronald Post's legal and moral guilt," public defenders Joe Wilhelm and Rachel Troutman told the board in a written request for mercy.

"The death penalty should be reserved for cases where proof of guilt is reliable and the legal system produced a just result," they said. "Neither criteria is met in this case."

The Lorain County prosecutor argues that Post was the killer and as evidence points to Post's written no-contest plea in which he acknowledged responsibility for the crime.

That admission is "a compelling reason" why the board should reject clemency, Lorain County prosecutor Dennis Will said in a filing to the board before the hearing.

"Even though some of Post's personal admissions of criminal actions did not include an express and explicit personal admission that he was the shooter of Helen Vantz, all of Post's admissions amount to a confession by Post that he committed crimes at the Slumber Inn," Will wrote.

He also noted that Post signed a document prepared by the detective who conducted the lie detector test acknowledging he killed Vantz.

A federal judge plans a hearing later this month on Post's obesity claims.

Gifts That Say You (Kind of) Really Care

Facebook gifts Facebook gifts

Screenshot via Facebook.

The Web is terrible at offering gift advice. Consider this scenario: It?s your sister-in-law?s birthday in a couple of days. She?s one of those super people who?s always sending you gifts and cards. Wouldn?t it be nice to get her something nice, too?

Yeah, but it?s such a hassle. First, what does she like? You have no idea. You?ve heard she likes to read, but you?re not sure what sort of books she?s into. Well, maybe you could get her something you like? You love Curb Your Enthusiasm?what about getting her the first-season DVD set? But wait a second; lots of people can?t stand Larry David. Or maybe she?s a huge fan and already has the DVDs. You realize there are also social red lines here, too. She?s your sister-in-law, so you want something friendly but not too intimate. You love The League, too, but that show?s raunchy, sexist banter might offend her ?

Maybe you?re overthinking this. How about a nice box of chocolates? (She?s probably not allergic, right?) OK, but second problem. Do you have her address? You have an address?but that was from a year ago. Is it still good? OK, maybe you can call your mom to ask. But then you?d have to talk to your mom. And anyway, her birthday is in two days; you?d have to spring for express shipping to get it there on time. This is becoming costly. Just then you get a call from a client and completely forget about the gift. (Epilogue: Your sister-in-law wins the Powerball and shortly thereafter dies from an allergic reaction to a Snickers bar. You are conspicuously absent from her will.)

Notice that none of this is quite the Web?s fault. It?s better to call it a first-world social problem?the problem of giving nice gifts in a society where people are far-flung and loosely connected. But this is a problem that the Web, which exists to both sell things and connect people, should have solved long ago. Yet gift-giving has improved very little in the Web era. Amazon?s Wish Lists, which were launched in 1999, are the biggest innovation I can think of, but they?re only useful if your giftee is an Amazon shopper who maintains a list, which is a rare combination. The other major recent innovation is electronic gift cards, which are basically just another way to give cash.

Earlier this year, though, a startup called Karma launched a mobile app that I considered a breakthrough for gifting. The app alerted you to your friends? special occasions, recommended gifts they might like, took care of all the pesky gifting logistics, and, best of all, gave the giftee a sense of joy even before the thing arrived. Karma did a lot of this by plugging into the world?s most-comprehensive repository of social relationships?Facebook. It wasn?t much of a surprise, then, when Facebook announced that it had acquired the small firm last spring.

The Karma team began working at Facebook on May 18, 2012?which happened to be the day that Facebook?s stock went public. Lee Linden, Karma?s 30-year-old co-founder, told me that the group skipped Facebook Bootcamp, a six-week orientation program that new engineers at the firm take to get up to speed with Facebook?s technology. Instead, they got right to work on a new service, called Facebook Gifts, which is a version of Karma that?s built into Facebook?s mobile and desktop sites.

That service launched in September, and it?s slowly rolling out to Facebook?s users. (At the moment, a mere ?tens of millions of people? have access, Linden says.) Facebook Gifts is a work in progress, but in my experience, it?s the best way to give gifts on the Web today. It?s also a perfect synthesis of Facebook?s grander business aims?to combine social relationships and commerce in a way that?s profitable for the company and not annoying for users. It has the potential to become something more, too: a solution to the world?s gifting woes, a way to quickly, easily, and thoughtfully make the people around you feel like you care.

Last week, I bought a gift for my wife using the service. I cajoled her into buying me one, too, so that I could experience Facebook Gifts from both sides of the transaction. I found the whole thing fantastically easy. More than that, though, it felt special?even though the situation was self-engineered, when I got the gift in the mail yesterday, I felt like my wife had put a lot of thought into the process.

If you have access to Gifts, you?ll see small links for it all over Facebook?for instance, under announcements of your friend?s birthday, you can click, ?Give him a gift.? You can also just go to anyone?s page and click the gift button. Do that and you?ll see a pop-up menu of potential presents for your giftee. Facebook has signed up more than 200 large and small merchants to source its gifts. They range from the generic (Starbucks and iTunes gift cards) to the helpful (a ride in an Uber cab) to the artisanal (my wife bought me Grady?s Cold Brew iced-coffee concentrate, made by a small Brooklyn firm) to the quirky (a kitchen apron you can doodle on). Gifts range from $5 all the way to hundreds, not including shipping and tax. The service recommends a handful of gifts that your recipient might like, but it also lets you choose anything from its catalog. Choose something, pick a digital greeting card to go along with your gift, and then add a nice note. If you?ve never given a gift on Facebook before, you?ve got to enter your payment details, too. You can also decide whether or not you?d like your gift to be announced on your recipient?s Facebook Timeline. Then press send.

Now your friend immediately gets a notice that she?s received a gift. She clicks or taps on it, gets your snazzy digital greeting card, and then sees what you bought her. The item itself usually arrives in three to five days. Now, I know what you?re thinking: Digital greeting cards are cheesy. You?re right. But that?s only because they?re usually empty; they say it?s the thought that counts, and pressing a few buttons on the Web to congratulate someone is nearly mindless. (That?s also why the mindless rush to write ?Happy Birthday!? when Facebook alerts you that it?s some random person?s special day is, to quote Slate editor David Plotz, ?a symbol of all that is irritating about the social network.?)

Nurse duped by Queen prank call found dead

The hospital receptionist who was hoaxed by a prank call from a DJ claiming to be the queen asking about Kate Middleton has been found dead.

"It is with very deep sadness that we confirm the tragic death of a member of our nursing staff," the hospital said in a statement released today.

The nurse was identified as Jacintha Saldanha. The hospital said that Saldanha worked at the hospital for more than four years. They called her a "first-class nurse" and "a well-respected and popular member of the staff."

"We can confirm that Jacintha was recently the victim of a hoax call to the hospital," the statement said. "The hospital had been supporting her throughout this difficult time."

The hospital extended their "deepest sympathies" to family and friends, saying that "everyone is shocked" at this "tragic event."

"She will be greatly missed," the hospital said.

Earlier this week, the hospital fell for a prank call from an Australian radio show where the hosts pretended to be Queen Elizabeth II and Prince Charles looking to speak to Kate Middleton, who had been admitted to the hospital for her pregnancy. The call was put through to a second nurse who told the royal impersonators that Kate was "quite stable" and hadn't "had any retching."

Saldanha was the nurse who transferred the impersonators to the second nurse who gave information about Kate's condition.

"The Duke and Duchess of Cambridge are deeply saddened to learn of the death of Jacintha Saldanha," a spokesman from St. James Palace said in a statement.

"Their Royal Highnesses were looked after so wonderfully well at all times by everybody at King Edward VII Hospital, and their thoughts and prayers are with Jacintha Saldanha's family, friends and colleagues at this very sad time," the statement said.

Police were called to an address near the hospital at about 9:35 a.m. GT today to "reports of a woman found unconscious," according to a statement from Scotland Yard.

The woman was pronounced dead at the scene. "Inquiries continue to establish the circumstances of the incident. Next of kin have been informed," the statement said.

Circumstances of the death being investigated, but are not suspicious at this stage, according to police.

The duchess spent three days at the hospital undergoing treatment for hyperemesis gravidarum, severe or debilitating nausea and vomiting. She was released from the hospital on Thursday morning.

The Tuesday morning prank call came from Australian DJ's Mel Greig and Michael Christian. They impersonated the royals, complete with exaggerated accents. They even enlisted two co-workers to bark like the queen's pet corgis.

The Sydney radio station, 2DayFM, could not be immediately reached for comment.

The Twitter accounts of both radio personalities have been deactivated, but it is unknown when the accounts were shut down. The DJ's are being heavily criticized on Twitter, with many people calling for them to resign or be fired.

The queen impersonator asked for her granddaughter and was promptly transferred to another hospital employee.

"I'm just after my granddaughter, Kate. I want to see how her little tummy bug is going," the radio host said, suppressing laughter.

"She's sleeping at the moment, and she has had an uneventful night and sleep is good for her," the nurse said. "She's been getting some fluids to rehydrate her because she was quite dehydrated when she came in, but she's stable at the moment."

The fake royals went on to ask when would be a good time to visit and were told that "anytime after 9 o'clock would be suitable."

"She's quite stable at the moment. She hasn't had any retching ... since I've been on duty. And she has been sleeping on and off. I think it's difficult sleeping in a strange bed as well," the nurse said.

The hospital apologized for the mistake.

"The call was transferred through to a ward, and a short conversation was held with one of the nursing staff," the hospital said in a statement. "King Edward VII's Hospital deeply regrets this incident."

"This was a foolish prank call that we all deplore," John Lofthouse, the hospital's chief executive, said in the statement. "We take patient confidentiality extremely seriously, and we are now reviewing our telephone protocols."

The radio station has since apologized for the prank call.

"2Day FM sincerely apologizes for any inconvenience caused by the inquiry to Kate's hospital. The radio segment was done with lighthearted intentions," the station said in a statement.

"We were very surprised that our call was put through. We thought we'd be hung up on as soon as they heard our terrible accents," the radio hosts said in the statement. "We're very sorry if we've caused any issues, and we're glad to hear that Kate is doing well. We wish Kate and her family all the best."

Two conservative Republicans booted from House budget panel

WASHINGTON (Reuters) - Two of the most conservative Republicans in the House of Representatives have been kicked off the House Budget Committee, a rare move that could make it easier for the panel to advance a deal with Democrats to cut fiscal deficits.

Representatives Tim Huelskamp of Kansas and Justin Amash of Michigan - both favorites of the anti-tax Tea Party movement - are among those Republicans voting most often against House Speaker John Boehner.

Huelskamp and Amash, who both will begin second terms in the House next month, voted against last year's deal to raise the federal debt limit and staunchly oppose any tax increases. Boehner has now included new revenue in his latest offer to avert the "fiscal cliff" of year-end tax hikes and automatic spending cuts. Given their voting records, winning support from Huelskamp and Amash for such a compromise seemed an uphill battle.

Huelskamp released a statement saying the Republican leadership "might think they have silenced conservatives but removing me and others from key committees only confirms our conservative convictions.

"This is clearly a vindictive move and a sure sign that the GOP establishment cannot handle disagreement," he said.

Huelskamp and Amash had said that despite sweeping changes to the Medicare and Medicaid healthcare programs, committee chairman Paul Ryan's budget did not make deep enough cuts to entitlement programs and military spending.

Boehner spokesman Michael Steel declined to be specific on the reasons for their ouster by the House Republican Steering Committee, which occurred Monday in a closed-door meeting.

"The Steering Committee makes decisions based on a range of factors," Steel said.

Huelskamp said he was given "limited explanation" for his removal from the Budget Committee, a move he called "vindictive." A spokesman for Amash could not be immediately reached for comment.

Huelskamp and Amash cast the only House Budget Committee votes against Ryan's budget plan earlier this year.

While there is often wrangling over committee chairmanships just before a new Congress takes office, it is rare for rank-and-file committee members to be stripped of their assignments.

The 34-member Republican steering committee is headed by Boehner and includes members of House leadership, committee chairs and other lawmakers representing different regions of the country.

The same group last week recommended that Ryan, the conservative former Republican vice presidential candidate, be renewed as Budget Committee chairman.
